Lệnh hành chính

Hội đồng Y tế Tiểu bang (Hội đồng) ban hành Lệnh hành chính để giải quyết tình trạng nhà máy nước không tuân thủ Luật cung cấp nước công cộng của Virginia và Quy định về nhà máy nước.  

Lệnh hành chính nêu ra các vi phạm cụ thể và yêu cầu công ty cấp nước phải có hành động khắc phục để trở lại tuân thủ theo lịch trình đã định.  Ngoài ra, Lệnh hành chính thường bao gồm khoản tiền phạt dân sự mà chủ sở hữu nhà máy nước phải trả.

Nếu chủ sở hữu nhà máy nước không tuân thủ Lệnh hành chính, Sở Y tế Virginia sẽ chuyển vấn đề này đến Văn phòng Tổng chưởng lý để thực hiện hành động cưỡng chế thông qua thủ tục tố tụng tại tòa án.

Có hai loại Lệnh hành chính:

  • “Lệnh đồng ý” là thỏa thuận tự nguyện giữa Hội đồng và chủ sở hữu công trình cấp nước để giải quyết các vi phạm.
  • “Lệnh đặc biệt” được Ủy viên Y tế Tiểu bang ban hành thay mặt cho Hội đồng, yêu cầu chủ sở hữu nhà máy nước giải quyết các vi phạm. Lệnh đặc biệt được ban hành mà không cần sự đồng ý của chủ sở hữu nhà máy nước sau khi chủ sở hữu đã có cơ hội tham gia phiên điều trần hành chính.
